Terms and Conditions

Effective Date: December 29, 2025

These Terms & Conditions (“Terms”) govern your access to and use of OasisGardenATL.com (the “Site”) and certain related interactions with Oasis Garden (“Oasis Garden,” “we,” “us,” or “our”), including reservations and bookings made through Toast and OpenTable, ticketed events, and on-premises policies referenced on the Site. By using the Site or booking with us, you agree to these Terms. If you do not agree, do not use the Site.

1) Site Purpose and Updates

The Site provides information about Oasis Garden, including menus, hours, events, and ways to contact us. We may update the Site, our offerings, and these Terms at any time. Changes are effective when posted. Your continued use of the Site after changes means you accept the updated Terms.

2) Booking Platforms (Toast + OpenTable)

Oasis Garden uses Toast and OpenTable (and may use additional approved platforms from time to time) to accept reservations and manage booking workflows.

  • When you book through a third-party platform, your booking is also subject to that platform’s terms and policies.
  • A reservation is confirmed only when you receive confirmation through Toast/OpenTable or directly from Oasis Garden.

3) Menu, Pricing, Availability, and Service Speed

We strive to keep information accurate, but menu items, pricing, availability, hours, specials, and event details may change without notice. Some items may sell out. Photos and descriptions are for illustrative purposes and may not reflect current offerings exactly.

Because many items are prepared to order, service speed varies based on volume, staffing, and kitchen workflow. Any timing estimates communicated online or on-site are estimates only and not guaranteed.

4) Deposits, Minimums, Pre-Orders, and Authorization Holds

For certain high-demand time periods, VIP seating, cabanas, holidays, special experiences, or events, Oasis Garden may require one or more of the following:

  • Deposits
  • Prepaid minimum spend
  • Pre-ordered items
  • Card-on-file and/or authorization holds to reduce no-shows

These requirements will be disclosed at booking/confirmation and become part of these Terms. Where applicable, deposits and prepaid amounts may be applied toward eligible purchases as described at booking.

5) Standard Cancellation Windows (Tables + VIP Cabanas)

Unless your booking confirmation explicitly states otherwise, Oasis Garden’s standard cancellation windows are:

A. Tables – 24-Hour Cancellation Window

You must cancel at least 24 hours prior to your reservation start time to avoid cancellation/no-show fees and forfeiture of any deposit or prepaid amount.

B. VIP Cabanas – 24-Hour Cancellation Window

You must cancel at least 24 hours prior to your cabana reservation start time to avoid cancellation/no-show fees and forfeiture of any deposit or prepaid amount.

Operational Flex Clause (Protective): For certain peak nights or special events, Oasis Garden may require a longer window (such as 48 hours) for VIP cabanas, but only if that requirement is clearly disclosed at the time of booking/confirmation.

6) Late Arrival, Seating Holds, and No-Shows

A. Late Arrivals

We may hold your table or cabana for a limited time. If you arrive late:

  • Your seating time may be reduced, and/or
  • Your reservation may be cancelled to protect capacity and operations.

B. No-Shows

If you do not arrive for your reservation:

  • Deposits and prepaid amounts may be forfeited, and
  • A no-show fee may be charged if disclosed at booking (including card-on-file agreements through Toast/OpenTable).

7) Ticketed Events, Special Experiences, and Refund Policy

For ticketed events, prepaid experiences, and special packages:

  • All sales are final unless otherwise stated in writing or required by applicable law.
  • If Oasis Garden cancels an event, we may (at our discretion and as permitted by law) offer a rescheduled date, a credit, or a refund to the original payment method. Third-party processing fees may be non-refundable.
  • No refunds for non-attendance, late arrival, or denied entry due to age/ID issues, dress code, or policy violations.
  • If an event is modified due to weather, talent availability, safety concerns, operational needs, or other factors, tickets remain valid and refunds are generally not issued.

8) Automatic Gratuity / Service Charge

Oasis Garden applies an automatic 21% gratuity to all parties of 5 or more guests, including VIP cabanas and special sections. Additional tipping is optional.

We may apply gratuity to other group situations (such as large orders or special experiences) when disclosed before purchase/confirmation.

9) Age Restrictions and Identification

Certain nights, sections, or event formats may be age-restricted (for example, 21+ during select evening hours or ticketed experiences). Age restrictions will be posted on the Site, in event materials, or communicated during booking.

  • Valid government-issued photo ID may be required.
  • We reserve the right to refuse entry or service if age requirements are not met or ID cannot be verified.
  • No refunds will be provided for denied entry due to age/ID issues.

10) Dress Code and Prohibited Items

Oasis Garden maintains an upscale, guest-ready environment. A dress code may apply for certain nights, events, or VIP seating and may be updated at our discretion.

Prohibited items and conduct include, without limitation:

  • Weapons of any kind
  • Illegal substances
  • Outside alcohol
  • Large bags/coolers (subject to staff discretion)
  • Clothing/accessories that obscure identity (e.g., masks) where not medically required
  • Clothing with explicit, hateful, or disruptive messaging
  • Disorderly conduct, harassment, threats, or refusal to follow staff direction

We reserve the right to refuse entry or service and/or remove guests to protect safety and operations. No refunds will be issued when removal is due to policy violations or unsafe/disruptive behavior.

11) Decorations, Banners, Signage, and Outside Vendors

To protect the brand environment and safety standards:

  • No banners, signage, step-and-repeats, balloon displays, confetti, glitter, table décor, or outside décor installations are permitted without prior written approval from Oasis Garden.
  • If approved, placement, sizing, materials, timing, and safety requirements must be followed. Additional fees may apply.
  • No outside food or beverage unless expressly approved in writing.
  • Any third-party vendor (e.g., photographer, decorator, entertainer) must be approved in advance and may be required to provide proof of insurance.

12) Weather Policy for Outdoor Seating and Experiences

Oasis Garden includes outdoor seating and experiences that may be affected by weather (rain, wind, lightning, extreme heat/cold, advisories, etc.). For guest safety and operational continuity, we may:

  • Relocate seating (where available)
  • Delay or modify service flow
  • Adjust experience components

Unless Oasis Garden cancels an event entirely, weather-related changes typically do not qualify for refunds. For ticketed events, Section 7 controls.

13) Photography, Video, and Content Capture

Oasis Garden may take photos or video in public areas of the venue for marketing, social media, and promotional use. By entering the venue and participating in events, you acknowledge you may be captured incidentally.

If you have a specific concern, notify a manager on-site. We will make reasonable efforts to accommodate when operationally feasible.

14) Third-Party Links and Services

The Site may include links to third-party websites or services (including Toast, OpenTable, delivery providers, or social media). We do not control and are not responsible for third-party content, availability, or policies. Your use of third-party services is governed by their terms.

15) Intellectual Property

All content on the Site—including logos, branding, text, images, videos, graphics, and design elements—is owned by Oasis Garden or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or commercially use Site content without prior written permission.

16) Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Oasis Garden disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access, error-free operation, or that the Site will be free of harmful components.

17) Limitation of Liability

To the fullest extent permitted by law, Oasis Garden will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of (or inability to use) the Site. Our total liability for any claim relating to the Site will not exceed $100 or the amount you paid to us through the Site in the prior 12 months (if any), whichever is greater, unless applicable law requires otherwise.

18) Indemnification

You agree to indemnify and hold harmless Oasis Garden and its owners, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another.

19) Privacy

Your use of the Site is also governed by our Privacy Policy.

20) Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute related to these Terms or the Site shall be brought in the state or federal courts located in Fulton County, Georgia, and you consent to that jurisdiction.
